Kanpur, 20 Sept: A seven-year-old boy has been charged with sexually abusing a five-year-old girl in Uttar Pradesh’s Kanpur Dehat district.
On Sunday night, the incident was reported at a village within the jurisdiction of the district’s Akbarpur police station after the girl’s mother accused a kid from their village of sexually abusing her daughter.
The mother of the five-year-old child stated her daughter had gone outside to play when the event occurred. Both children were taken to the district hospital after their mother notified the police, and a medical report proved rape.
Meanwhile, on Tuesday, police filed a FIR under sections 376 of the IPC and 5/6 of the POCSO Act in response to the girl’s mother’s allegation.
Notably, Section 82 of the Indian Penal Code, 1860, Chapter IV stipulates that “nothing done by a child under the age of seven is an offence.” As a result, no kid under the age of seven may be held criminally liable.
Satish Singh, an inspector at Akbarpur Kotwali police station, stated that authorities were treating this matter with care. “If a child under the age of seven commits a crime, it is not considered a crime. Nonetheless, no further action will be done in this matter until a legal opinion is obtained. The FIR was filed on Tuesday,” he explained.
