New Delhi, 17 November: The Supreme Court has agreed to hear a petition challenging the collegium system for judges’ appointment. Advocate Mathew J Nedumpara on Thursday mentioned before a bench headed by Chief Justice DY Chandrachud, seeking early hearing of the petition.
The Chief Justice said that the Constitution Bench of the Supreme Court has upheld the collegium system. He said that the petition challenging this under Article 32 may not be maintainable, however, the Chief Justice said that its merits would be examined and listed for hearing.
The petition states that the collegium system for the appointment of judges in the higher judiciary is against the spirit of the Constitution, which seeks to appoint qualified judges. The collegium system is proving to be monopolistic in the appointment of judges, it said.
The Supreme Court Constitution Bench, in 2015, upheld the collegium system.
