Mumbai, January 10: Maharashtra Assembly Speaker Rahul Narvekar has finally rejected the disqualification petition of 16 MLAs on Wednesday on the orders of the Supreme Court.
Narvekar did not consider the MLAs of Shinde faction as ineligible, but considered Shinde faction as the real Shiv Sena.
Rahul Narvekar on Wednesday announced his decision in the Legislature on the disqualification petition of 16 MLAs.
He said in his decision that after studying all the evidence, he has come to the conclusion that Shiv Sena (Shinde Group) is the real Shiv Sena.
On the basis of majority, Eknath Shinde is the leader of the party, hence the appointment of Chief Whip Bharat Gogavale is right.
Rahul Narvekar said that the documents presented at the time of hearing on Sunil Prabhu’s petition showed that the Shiv Sena chief was not elected on the basis of voting. No party head has the right to take decisions on the basis of his own mind. The party chief does not have the right to expel anyone from the party, this right rests with the national executive of the party.
Speaker said in this matter, the decision to remove Eknath Shinde from the post of leader has not been taken in the Shiv Sena National Executive. For this reason, the appointment of Bharat Gogavale to the post of Chief Whip on behalf of Eknath Shinde has been found correct. Similarly, during the election for the post of Assembly Speaker, only Bharat Gogavale’s whip is valid. Rahul
Narvekar said that during the hearing of the petition, Sunil Prabhu could not answer the questions of lawyer Mahesh Jethmalani. Also, the papers presented by Sunil Prabhu were also not found correct. For these reasons, the petition to disqualify 16 MLAs including Eknath Shinde has been rejected.
