Delhi, May 13: The Supreme Court has rejected the petition demanding the removal of Arvind Kejriwal from the post of Chief Minister of Delhi. The bench headed by Justice Sanjeev Khanna has also refused to interfere in the order of the Delhi High Court.
The Supreme Court said that the petitioner was not even a party in the Delhi High Court. The Lieutenant Governor of Delhi has to decide on this matter. The petition was filed by Kant Bhati.
It was said in the petition that according to the provisions of Section 239AA (4) of the Constitution, the Chief Minister is the head of the Council of Ministers who advises the Lieutenant Governor. It is not practically possible to advise the Lieutenant Governor after Arvind Kejriwal is in jail. In such a situation, an order should be issued to remove Arvind Kejriwal from the post of Chief Minister.
After this, the Supreme Court has rejected the petition demanding the removal of Arvind Kejriwal from the post of Chief Minister of Delhi.
Earlier, on April 10, the Delhi High Court had refused to hear the petition of former Aam Aadmi Party MLA Sandeep Kumar demanding the removal of Arvind Kejriwal from the post of Chief Minister. Expressing strong displeasure over the petition, the bench headed by Acting Chief Justice Manmohan had ordered a fine of Rs 50,000 on former Delhi MLA Sandeep Kumar.
It is noteworthy that the Supreme Court had ordered the release of Kejriwal on interim bail on May 10. Along with this interim bail, the Supreme Court had ordered Kejriwal to surrender in the court on June 2.
