Jamiat Ulama-e-Hind challenges Waqf (Amendment) Act, 2025 in Supreme Court

New Delhi, 06 April: After the President’s assent to the Waqf (Amendment) Act, 2025 passed by both the houses of Parliament, Jamiat Ulama-e-Hind has challenged the constitutional validity of this law in the Supreme Court.

Jamiat Ulama-e-Hind President Maulana Arshad Madani says that this law is a direct attack on the Indian Constitution. The Constitution of India not only gives equal rights to all citizens, but also provides complete religious freedom. This law is a conspiracy to snatch the religious freedom of Muslims, which is completely against the Constitution.

Jamiat Ulama-e-Hind President Maulana Arshad Madani said that we had already made it clear that if this bill becomes a law, we will challenge it in the country’s Supreme Court. Therefore, as soon as the President’s approval was given, Jamiat has filed a writ petition in the Supreme Court against this law today.

He said that the state units of Jamiat will also file petitions against this law in the High Courts of the respective states. He has full faith in the judiciary that we will get justice even on this unconstitutional law. Criticizing the so-called secular parties, he said that we made every possible effort to stop this law, but the parties calling themselves secular not only traded the interests of Muslims, but also crushed the Constitution under their feet and exposed their true face to the whole country.

Maulana thanked all those secular MPs who remained in Parliament till late night and exposed the possible ill-effects of this law through their speeches. He also thanked those justice-loving citizens who kept raising their voice against this law outside the Parliament.

He said that this proves that even today there are people in the country who have the courage and passion to speak against injustice. This law is not only an interference in religious matters, but is against the religious freedom granted by the Constitution and its guiding principles.

He said that this law has been brought in the name of the welfare of Muslims, but in reality it is a serious attack on their religious freedom. Not only have various sections of the Waqf (Amendment) Act, 2025 been challenged, but an appeal has also been made to the court for interim relief (interim order) to stop the implementation of this law. This petition has been filed under Section 1(2) of the Amendment Act. Advocate on Record Fuzail Ayyubi has filed this petition in the Supreme Court.
