Ghaziabad: NGT rebukes Ghaziabad Municipal Corporation and UP Pollution Ctrl Board

New Delhi, 29 January: The National Green Tribunal (NGT) has pulled up the Ghaziabad Municipal Corporation (GMC) and the Uttar Pradesh State Pollution Control Board for not taking action against illegal dairies operating in Chiranjeev Vihar, Ghaziabad.

Justice Sudhir Agrawal, judicial member of the NGT, has summoned the reply of Ghaziabad Municipal Corporation, Ghaziabad City Health Officer and State Pollution Control Board within two days.

In fact, petitioner Vedprakash Goel told the NGT that its order dated October 8, 2020 has not been complied with. He said that 14 dairies were running illegally in Chiranjeev Vihar despite the order of the NGT.

However, taking note of the submissions of the petitioner, the NGT had on September 8, 2021 directed the Ghaziabad Municipal Corporation and the Uttar Pradesh Pollution Control Board to take action against the dairies violating environmental norms.

After the order of the NGT, the GMC submitted its action taken report on December 8, 2021, saying that the Regional Sanitation Officer and Regional Food Officer of Kavi Nagar inspected the area and found that the orders of the NGT were being violated.

Acting on this, Safai Nayak of Kavi Nagar directed the SHO of Kavi Nagar police station to register an FIR against the dairies violating the NGT order.

On December 4, 2021, Kavi Nagar’s Regional Sanitation Officer and Regional Food Officer again wrote a letter to the SHO to register the FIR due to non-registration of FIR. The letter asked to register an FIR under Section 31A of the NGT Act.

Meanwhile, the GMC said that according to the government order of Uttar Pradesh, if encroachment is being done in the residential area, then action will be taken by the Development Authority and the Housing Development Council. Then the NGT has given powers to the Ghaziabad Municipal Corporation to prevent pollution, and then no response was received from the Ghaziabad Municipal Corporation.

Then Mithilesh Kumar, City Health Officer of Ghaziabad said that they will take action within 48 hours. The NGT then ordered the next hearing of the matter on February 1, giving two days’ time.

The NGT directed the Ghaziabad Municipal Corporation and the Uttar Pradesh Pollution Control Board to file fresh compliance reports of the order.
