Prayagraj, April 11: The Allahabad High Court has held that rape is not only a crime against the victim, but it is a crime against the entire society. This violates the fundamental rights of life. If action is not taken, people will lose faith in the justice system.
The court said that 20 years imprisonment, which may extend to life imprisonment, for raping a minor girl of 08 years. Also fine may be imposed. Therefore, the accused cannot be presumed innocent before the trial. The court has refused to release the accused of molesting an eight-year-old minor girl on bail and rejected the bail application.
Justice Sanjay Kumar Singh has given this order on the application of Chandra Prakash Sharma, accused of Gorakhpur, Bansgaon. The court referred to the Supreme Court and said that it hurts the soul of the helpless girl. The innocence of the accused cannot be decided before the completion of the trial.
The court said that the eight-year-old girl does not know the rape and its consequences. Girls are worshiped in India. Despite this, the crime of molesting girls is increasing. Girls are becoming victims of mental harassment and depression. Some are ending their lives. In many cases such incidents are suppressed to save the honor of the family.
It is known that on July 16, 21, the 8-year-old rape victim had gone next to the house to pluck guava. Where the petitioner molested and raped. When the girl came home and told her, a medical examination was conducted and an FIR was lodged. The accused is lodged in jail since July 17.
The sessions court had rejected the bail application. On which this application was filed in the High Court claiming that he was innocent. The petitioner said that the hymen is not broken. Bleeding was not found at the time of medical examination. In the statement also, the victim has not called rape. But the court refused to accept these arguments.
