Varanasi, May 11: In the survey case of Gyanvapi premises, the petition filed in the court of Civil Judge (Senior Division) Ravi Kumar Diwakar for change of court commissioner was heard again on Wednesday.
For the third consecutive day, the advocates of the plaintiff and the defendant side presented their arguments in the court. After the hearing is over, the court has reserved its verdict.
At 12 noon on Thursday, the court will give its verdict on the demand for change of survey-videography and advocate commissioner.
District Government Advocate (Civil) Mahendra Prasad Pandey told the media personnel that the plaintiffs argued for a clear order to survey every part of the Gyanvapi complex. At the same time, the Muslim side has demanded to change the Advocate Commissioner. Both the parties have put forward arguments and objections in their petition.
Now the court will give its verdict in this matter on Thursday, May 12.
Advocate Subhash Nandan Chaturvedi, appearing for the plaintiff, said that the arguments of the advocates of the respondent Anjuman Intejamia Masjid Committee were futile. The respondent side deviated from the original subjects and presented its arguments.
He bluntly said that when this side was present on April 26 and on the same day everything was decided that the commission was to be held. Court commissioner’s and he is also running continuously.
He questioned that the commission’s action has been taken for two days, how the defendants can obstruct it now.
Chaturvedi said that there is no such provision in the CPC that any court commission should be stayed without completing the proceedings. Respondents are still adamant on the same demand, while after hearing all the sides, the court has reserved the order for Thursday.
Earlier on Tuesday, there was an argument between the advocates of the plaintiff and the defendant side in the court for about two hours.
During this both the sides presented their arguments. The plaintiffs appealed for a direction to the administration to ensure the commission’s proceedings.
The respondent side put forward its stand for replacement of Advocate Commissioner. In front of the court, the plaintiff also informed about the obstruction caused by the defendant side during the commission proceedings. An advocate for the plaintiff requested the court to proceed to the spot.
He also referred to the case related to Din Mohammad Vs. Secretary of India for this.
It may be noted that the advocates of the respondent Anjuman Inazaniya Masajid Committee had filed an application in the court on May 7, objecting to the Advocate Commissioner Ajay Kumar Mishra appointed for the survey from the court. Advocates for the respondent side say that the Advocate Commissioner is not doing the survey work in a fair manner, but he is working like a party. So the court should appoint another commissioner.
On the petition of the respondent, the court has asked the plaintiff and the advocate commissioner to file their side. At present, no decision has been taken on the demand of removal of the Advocate Commissioner of the Respondent side.
Five women, including Delhi resident Rakhi Singh, had filed a petition in the court on August 18 2021 for regular worshipping at Shringar Gauri located inside the Gyanvapi Masjid complex.
By filing a petition in the court of Civil Judge Senior Division Ravi Kumar Diwakar, the women have demanded regular โdarshanโ-worship of Shringar Gauri and other Deities located at Kashi Vishwanath Dham-Gyanvapi complex as before 1991.
