Allahabad HC nixes PIL seeking to declare election of 99 Congress MPs illegal

Prayagraj, 20 August: Allahabad High Court on Tuesday dismissed the PIL seeking to declare the election of 99 Congress MPs illegal, cancel the registration of the party and confiscate the election symbol.

The court dismissed the petition on the basis of withdrawal on the request of the petitioner’s advocate and allowed the petitioner to file the petition again with detailed details. This order was passed by a division bench of Justice MK Gupta and Justice Manish Kumar Nigam on the petition of social worker Bharti Devi.

It was said in the petition that the Congress issued a guarantee card in the Lok Sabha elections 2024, in which the poor, backward, Dalit and minorities were lured to vote by falsely promising to give Rs 8500 per month after the election. This act is a violation of the Representation of the People Act. It was said in the petition that Congress issued guarantee cards, which bear the signatures of Congress President Mallikarjun Kharge and Rahul Gandhi. The petitioner says that a complaint was made to the Central Election Commission in this regard earlier. The Election Commission issued an advisory notice to all political parties including Congress on 02 May 2024, but Congress and its allies did not withdraw the guarantee card even after the notice. This act of Congress is a violation of the People’s Representation Act. It is also a crime under BNS. This act of Congress is also a blatant violation of the Model Code of Conduct. is noteworthy that in the recently held Lok Sabha elections, Congress has won a total of 99 seats across the country.
