Allahabad High Court stays demolition action for 4 weeks

Prayagraj, 16 June: The Allahabad High Court has stayed for four weeks the demolition drive being carried out by the Public Works Department (PWD) in Sadar Tehsil of Ballia.

Along with this, the Superintending Engineer of the PWD has been directed to pass an order on the representation of the petitioner within two weeks.

This order was given by the division bench of Justice Manoj Kumar Gupta and Justice Sameer Jain while hearing the petition of Alok Kumar Ojha and six others.

Advocate Sanjeev Singh of the petitioners argued that the shop of the petitioners is taking action to demolish the shops located on plot number 499 Khan in Village Phephna, Post Kopachit Sarki, Tehsil Sadar, Ballia under the anti-encroachment drive. No order has been passed by the respondents in this regard.

The petitioners also filed an objection in this regard before the District Magistrate (DM) on June 6, but the DM did not pass any order.

On this, the court directed the Superintending Engineer of the PWD to consider the representation of the petitioners and take a decision in two weeks.

The court has also ordered the petitioners to submit a representation regarding the demolition before the superintending engineer which they have to think about.
