Mumbai, 20 January: The Bombay High Court on Monday ordered to register a case against five policemen concerned in the encounter case of Akshay Shinde, accused in Badlapur rape case, after the magistrate investigation report was tabled.
The sealed investigation report of Thane Magistrate in the encounter case of the accused in Badlapur rape case was presented before the division bench of Justice Revati Mohite Dere and Neela Gokhale in Bombay High Court on Monday.
After seeing this report, the division bench said that in the report the magistrate has concluded that five policemen are responsible for the death of accused Akshay Shinde. In this case, according to the law, a case should be registered against the five policemen and an investigation should be conducted.
The division bench directed to provide a copy of the investigation report to the prosecution and Anna Shinde.
The division bench asked government lawyer Hiten Venegaonkar to tell the bench in two weeks which investigating agency will investigate the Badlapur sexual harassment case. The Thane Magistrate’s investigation report presented in the court has blamed Thane Crime Branch Senior Police Inspector Sanjay Shinde, Assistant Police Inspector Nilesh More, Head Constable Abhijeet More and Harish Tawde and a police driver.
It is noteworthy that Akshay Shinde (24) was arrested in August 2024 for allegedly sexually assaulting two minor girls in the toilet of a school in Badlapur. Akshay was an attendant at the school. Shinde died in an alleged police encounter while being taken from Taloja jail for interrogation on September 23.
The police claimed that he had snatched a gun from a policeman sitting in the police van and fired. After this, Akshay was killed in retaliatory firing. The magistrate’s investigation has not found the accused’s fingerprints on the gun.
In this case, deceased Akshay Shinde’s father Anna Shinde has filed a petition in the High Court. In the petition, Anna claimed that the police killed his son in a fake encounter.
