Prayagraj, 07 November: Allahabad High Court has said that under the service rules, the District Basic Education Officer (BSA) does not have the jurisdiction to review or cancel any of his orders. It is beyond his jurisdiction to cancel his own order.
Along with this, the court has banned the District Basic Education Officer, Mathura, from canceling the order of reinstatement of the petitioner by permanently withholding one increment of the primary school headmistress and has asked the state government and other opposition parties to respond to the petition within three weeks.
The court has also directed to allow the petitioner to work and continue paying his salary. The next hearing of the petition will be on December 7.
Justice Manjeev Shukla has given this order on the petition of Seema, headmistress of Primary School, Pre-Secondary School, Bandi, Block Baldev, District Mathura. They said that the petitioner was suspended on the complaint of the parents.
By order of 8 May 23, BSA Mathura reinstated the petitioner by giving her the punishment of stopping the increment. She was posted as the headmistress of Pre-Secondary School, Birjapur Mathura.
On May 9, 23, the order was modified and the petitioner’s primary school was transferred to Pre-Secondary School, Bandi and on October 9, the petitioner was punished and the reinstatement order was withdrawn whose validity was challenged in the Allahabad High Court.
