Polygamy among Muslim men: Delhi HC directs Centre to file reply by Aug 23

New Delhi, 02 May: Delhi High Court has issued notice to the Central Government while hearing a petition challenging polygamy among Muslim men. A bench headed by Acting Chief Justice Vipin Sanghi directed to file the reply by August 23.

The petition has been filed by Reshma, a 28-year-old Muslim woman. The petition has demanded that Muslim men be declared unlawful for remarriage without the consent of their wife.

It has been said in the petition that the practice of polygamy among Muslim men is a cruel practice and it is insulting to women. It has been said in the petition that the Shariat allows polygamy in exceptional circumstances. These exceptional circumstances may be illness of the first wife or infertility.

During the hearing, the High Court was informed that the Supreme Court is also hearing the matter. The Supreme Court has referred the matter to the Constitution Bench.

The petitioner had married Mohammad Shoaib Khan in January 2019 under Muslim Personal Law in Delhi. She has an 11 month old baby. Her husband promised her that he would not marry anyone else for the rest of his life. Now her husband wants to divorce her and get married again.
