Punjab-Haryana HC cancels 75% domicile quota for Haryana locals in private sectors

Chandigarh, 17 November: Punjab-Haryana High Court on Friday, giving a big blow to the Haryana government, has canceled the law of 75 percent reservation in private sector jobs.

This law was challenged by the industrialists of Faridabad and Gurugram saying that the implementation of this law will have an adverse impact on productivity, quality of work and employment.

In fact, before the 2019 assembly elections, Jannayak Janata Party had announced this in its manifesto. Later, after the formation of the coalition government, the Labor Department also went to JJP and the government made the State Employment of Local Candidates Act 2020. In this, a provision has been made to give 75 percent reservation in jobs to the youth of Haryana to all such private institutions including private companies, societies, trusts, partnership firms. It was also provisioned that this reservation would be applicable only to those private institutions where 10 or more people are employed and the salary is less than Rs. 30 thousand per month.

The Labor Department had also issued a notification in this regard on November 6, 2021.

Industrialists from Faridabad and Gurugram challenged this law in the High Court. When this matter reached the High Court, it was stayed in February 2022. The Haryana government went to the Supreme Court against this. The Supreme Court had canceled the order of the High Court and asked to take a decision on this within 4 weeks.

After a long debate, Justice GS Sandhawalia and Justice Harpreet Kaur Jeevan reserved the decision in the High Court last month. On Friday, the High Court has canceled this law.

After the decision of Punjab-Haryana High Court, Haryana Advocate General Baldev Raj Mahajan said that we will soon file an appeal in the Supreme Court against the decision of the High Court. We will reinstate this law in the Supreme Court and implement the provision of giving 75 percent reservation to the people of Haryana origin.
