New Delhi, 06 November: The Supreme Court has extended the interim bail of former Delhi Minister Satyendra Jain till November 24.
A bench headed by Justice AS Bopanna ordered the court to hear Satyendar Jain’s regular bail plea on November 24.
ED had said on October 19 that Jain could be treated in custody also. Therefore the bail should be cancelled. On September 1, Justice Prashant Kumar Mishra, a member of the bench hearing the case, had recused himself from the hearing.
Justice Prashant Mishra’s son has appeared as ED’s lawyer. During the hearing on August 25, lawyer Abhishek Manu Singhvi, appearing for Satyendra Jain, had said that Jain has undergone spinal surgery and needs rest. Singhvi demanded extension of Jain’s interim bail.
The ED had opposed Singhvi’s argument and said that Jain should be ordered to surrender. His interim bail should not be extended even by a day. Jain should be treated like a common prisoner.
On July 24, the court had extended the interim bail granted to Jain by one month. On July 10, the court had ordered to extend the interim bail till July 24. Before this, on May 26, the Supreme Court had granted six weeks’ interim bail to Satyendar Jain. The court had allowed Satyendra Jain to get treatment in a private hospital of his choice.
Before the hearing, ED filed its reply saying that Satyendra Jain has been receiving wrong reports about the disease due to his influence. ED said that Delhi High Court had rejected the report of Loknayak Jaiprakash Hospital.
ED said that in money laundering case, bail is granted only when there is a threat to life due to illness.
The Supreme Court, while hearing the bail plea on May 18, had issued a notice to the ED. Advocate Abhishek Manu Singhvi, appearing for Jain, had cited Jain’s poor health and said that Jain’s weight had reduced by 35 kg in jail.
On April 6, Delhi High Court had rejected the bail plea of Satyendar Jain. The High Court had said that Satyendar Jain is an influential person and has the ability to influence witnesses.
The ED had opposed the bail plea in the Delhi High Court, saying that if Jain is granted bail, the lives of the witnesses in the case may be in danger.
ED had said that Satyendra Jain is an influential person and has held a big political position. He can influence witnesses. ED had said that Jain will also have to pass the triple test prescribed for bail.
On November 17, 2022, the Rouse Avenue Court had rejected the bail pleas of Satyendra Jain, Vaibhav Jain and Ankush Jain. ED had arrested Satyendra Jain on May 30, 2022.
