Supreme Court terms Calcutta High Court’s POCSO case remarks objectionable, needless, asks judges not to express their personal opinion

New Delhi, 8 December: The Supreme Court took suo motu cognizance of the remarks made by the Calcutta High Court while hearing the POCSO case and said that judges should not express their personal opinion in such cases.

Justice AS Oka has asked the West Bengal government to inform whether it has challenged this decision of the Calcutta High Court or wants to challenge it.

The Supreme Court has issued notice to the accused and the victim of this case. The Supreme Court said that judges should avoid preaching. The Supreme Court has called the High Court’s comments unnecessary and objectionable.

It is noteworthy that the Division Bench of Calcutta High Court, while hearing the POCSO case on October 18, had remarked that ‘minor girls should control their sexual desires instead of having two minutes of fun’.
