Supreme Court upholds Allahabad HC’s order on the use of DND Flyway toll-free

New Delhi, 20 December: The Supreme Court has given relief to the people using The Delhi- Noida Direct (DND) flyway. The Supreme Court made it clear in its decision that DND will remain toll free. The bench headed by Justice Suryakant has upheld the decision given by the Allahabad High Court in 2016.

The High Court had made the DND fly-way toll free. Toll company Noida Toll Bridge Company Limited (NTBCL) appealed to the Supreme Court against this decision of the High Court.

The Supreme Court said that the contract was given to NTBCL without issuing a public tender, which was a completely arbitrary and wrong decision.

The Supreme Court said that the agreement made between Noida Authority and NTBCL to collect toll was wrong. This agreement was made in such a way that the toll company was authorized to collect toll for eternity. Due to this agreement, several hundred crores of rupees were wrongly collected from the common people.

In this case, CAG had submitted its report to the Supreme Court on December 4, 2018.

During the earlier hearing on this case, the Noida Toll Bridge Company had said that the DND flyover is the best in the country and there are no potholes in it. On this, the bench headed by the then Chief Justice TS Thakur had said that you are taking credit for it as if you have built a road to the moon. When the toll bridge company said that if they win the case later, will they run after the people using DND to collect money? On this, the bench asked that if they lose, will they run to return the money.
