UP: Minor girl’s father seeks permission for abortion

Prayagraj, 04 June: The victim’s minor girl’s father has sought permission from the Allahabad High Court to abort the minor daughter, who became pregnant after coming in a relationship with a relative.

The High Court, while hearing her petition, directed the principal of Lala Lajpat Rai Memorial Medical College, Meerut, to constitute a board of four doctors and order to test the girl. It has been said that the report of the medical examination should be presented in a sealed cover in the court.

Meerut Additional Sessions Judge (First) has been asked to work in coordination with the concerned officers in this test work. Along with this, the court has also asked the SP Baghpat to provide security arrangements to the victim and others.

This order was given by Justice Manoj Kumar Gupta and Justice Chandra Kumar Rai while hearing a petition filed by the father of the minor girl.

The court has directed its registry not to disclose the name of the victim and her father to anyone anywhere. The court has said that it should not be made public.

The court has asked the principal of Meerut Medical College to constitute a four-member medical board consisting of one doctor each from the Gynecology, Psychiatry, Radiology or Sonology and Pediatrics department to examine the minor girl and on June 6, 2022 at 11 am.

The court has also asked the petitioner to appear before the medical board. The Medical Board shall submit its report after the examination in a sealed cover to the First Additional District Judge, Meerut, who shall immediately send it to the High Court.

The court has directed the medical board to conduct tests on a total of four things. It has been said that the board should send its report before the High Court by June 7.

The court has asked the copy of the order to be provided to the principal of Meerut Medical College within 24 hours so that the order can be properly followed.

In this case, the minor girl had a relationship with a relative. The girl has said in her statement that she has married a relative.

According to the sonography report, she is 16 weeks and five days pregnant. On coming to know about this, the father of the minor girl lodged an FIR against the relative.

During the investigation, the police have registered a charge of rape against the relative. POCSO Act has also been imposed on him.

The father said that his daughter and other family members are in shock due to this incident and also she got pregnant while being a minor has put the life of the petitioner in danger as well as her physical and mental health.

The petitioner has sought permission to terminate the pregnancy under Section 3 of the Medical Termination of Pregnancy Act, 1971. On this, the court has sought to know the status of abortion by constituting a medical board.

Medical board will examine these aspects

The duration of pregnancy.

Will there be any danger to the life of the victim by continuing the pregnancy?

Will the continuation of the pregnancy cause any serious damage to the physical and mental health of the victim?

Is there a substantial risk that the child, if born, will suffer from a serious physical or mental abnormality?
