
Allahabad High Court criticizes administrative officers for ignoring Supreme Court orders
Prayagraj, May 06: The Allahabad High Court has directed the Principal Secretary Home and the Finance Controller Police Headquarters Lucknow to file personal affidavits clarifying what steps have been taken to implement the Supreme Court’s order prohibiting the recovery of excess salary payments after the retirement.
The court said that in the Sushil Kumar Singhal case, the Supreme Court had prohibited the recovery of excess salary payments from retirement benefits under the Government Order (GO) of January 16, 2007 in 2014. Despite this, such cases are coming to the court every day. Administrative officers are not following the Supreme Court’s instructions. The next hearing of the petition will be on May 25. Justice Prakash Padia gave this order while hearing the petition of Girdhari Lal.
The Finance Controller, Police Headquarters, Lucknow, recovered the excess salary paid to the petitioner after his retirement. He refused to pay the benefits, which has been challenged.
The court said that the order of the Finance Controller is not only illegal but also in violation of the Supreme Court order. The petitioner had also submitted a copy of the Supreme Court’s decision along with the representation dated January 24, 2024, but unfortunately, it was not considered while refusing the payment. On which the court has sought affidavits from both the officers.
