Lucknow, 9 November: The Lucknow Bench of the High Court has dismissed the petition filed against the acquittal of the Babri case accused including LK Advani, Murli Manohar Joshi, Uma Bharti.
A two-member bench headed by Justice Ramesh Sinha had reserved its decision on October 31.
This appeal was filed in the court on behalf of Haji Mehboob Ahmed and Syed Akhlakh Ahmed, residents of Ayodhya. Initially, a revision petition was filed in the matter. It was ordered by the court to be converted into a criminal appeal. An objection was also filed on behalf of the CBI in the matter.
The CBI said that the appellants were not victims of the demolition case of the disputed structure. Therefore, the present appeal cannot be filed under the proviso to section 372 of CrPC. The appellants say that they are on the aggrieved side in this case because of the demolition of the disputed structure. Therefore, he has the right to challenge the decision of the Sessions Court.
Earlier, Advani, Joshi, late Kalyan Singh, Uma Bharti, MP Sakshi Maharaj, Lallu Singh and Brij Bhushan Sharan Singh were acquitted by the special court.
The verdict came after 28 years in the case of the demolition of the disputed structure in Ayodhya on December 6, 1992.
